Iraqi judicial delegation visits the Judiciary Research Institute

The meeting of the Iraqi judicial delegation visiting the Judiciary Research Institute was held this morning in the presence of Hojatoleslam Wal Muslimin Hadi, the head of the Judiciary Research Institute, and a number of members of the institute in the Shahid Beheshti Hall.

"We are happy with the opportunity that arose in this meeting, which will increase judicial interactions between the members of the two delegations and, in turn, increase cooperation between the two countries of Iran and Iraq," said Hojatoleslam Wal Muslimin Hadi during the meeting.

Stating that the research institute is a scientific and research pillar of the judiciary, he added, we would like to know if there is an institution corresponding to the Iranian Judiciary Research Institute in the Iraqi judicial and justice system.

Referring to the role of the research institute in increasing judicial interactions and helping to regulate judicial laws in the country, Hojatoleslam Wal Muslimin Hadi stated: Article 167 of the Constitution of our country, Iran, allows judges to refer to the fatwas of religious authorities, if necessary, which is similar to Article 1 of the Iraqi Civil Code.

Referring to the differences between the legal systems of Iran and Iraq, he stated: Article 167 of the Constitution of the Islamic Republic of Iran allows for the citation and use of reliable Islamic sources, reliable fatwas, and general legal principles when necessary. However, the laws of Iraq allow for reference to custom, resulting in differences between the laws of the two countries in this regard.

"The primary objective of the research institute is to provide scientific and research-based supporting documents, whether in preparing judicial bills or in solving problems that exist in the judiciary," stated the head of the Judiciary Research Institute, emphasizing that the actions and activities conducted by the institute are scientific and research-based.

Hojatoleslam Wal Muslimin Hadi declared: "Given the diversity of research institutes we have, if there is a problem, we will prepare and present a supporting and scientific document to resolve it." Mr. Hadi clarified that the Judiciary Research Institute's recommendations regarding queries and concerns brought up by judges and other judicial officials are advisory and not legally binding.

The head of the Iraqi delegation, Ahmad Hashem, also stated during the meeting that the Judiciary Research Institute is a specialized and scientific facility that is not found in Iraq.

He added, The Judiciary Research Institute is an important and significant center in helping to improve judicial processes. This center can certainly have a good scientific impact on Iranian society.

The head of the Iraqi delegation added, we hope that the Iranian delegation will provide our judges and colleagues with information and advisory opinions in the field of scientific and judicial studies. We are interested in using your experiences.
